NOTICE TO QUIT
TO: John Doe and Jane Doe, Tenant(s).
  1. Present Lease. You now rent apartment #2 located at 123 Red Road, Your City, Jersey, Zip, as Tenant(s).
  2. Termination of Lease. Your lease is TERMINATED (ended) as of March 31, 2013.
  3. Demand for Possession. You must leave and vacate this rented property on or before that date (date of termination). This means you must move out and deliver possession to me, your Landlord.
  4. Reason. Your lease is terminated because:

Disorderly conduct pursuant to N.J.S.A. 2A:18-61.1(b) and breach of landlord's rules pursuant to N.J.S.A. 2A:18-61.1(d). Specifically, you have been having loud parties late at night while other residents are trying to sleep. Police were called to the premises on January 14, 2013, January 16, 2013 and January 17, 2013. On January 18, your were sent a Notice to Cease, stating "You must cease all further disorderly activity. Failure to comply with this Notice will result in a Notice to Quit and an Eviction Action." Subsequent to that January 18 Notice, the police were called to your apartment on January 27 due to reports of another loud party.

For breach of landlord's rules pursuant to N.J.S.A. 2A:18-61.1(d). Specifically, your written lease, and your certificate of occupancy and your Housing Assistance Agreement limit your occupancy to 2 people. You are currently housing 6 people in your 2-bedroom apartment, which is also a violation of PMC 404.5. On January 18, 2013, you were sent a Notice to Cease, stating "You must remove all unauthorized occupants no later than February 16, 2013. Failure to comply with this Notice will result in a Notice to Quit and an Eviction Action." Thus far, you have failed to remove the unauthorized occupants.

For habitual late payment of rent, pursuant to N.J.S.A. 2A:18-61.1(j). Specifically, your written lease requires you to pay rent no later than the first day of each month. You have consistently paid your rent late each month, including the month of November, 2012, when you paid your rent on November 21, and December of 2012, when you paid your rent on December 15 and January of 2013, when you paid your rent on January 17. You were previously sent a Notice to Cease last year when you were late on your August and September rent. This is your final Notice to Cease. On January 18, 2013, you were sent a Notice to Cease, stating "Any further late payments will result in a Notice to Quit and an Eviction Action." Notwithstanding that Notice, your February rent payment was not received until February 11.

Willful or grossly negligent destruction, damage or injury to the rented premises, pursuant to N.J.S.A. 2A:18-61.1(c). Specifically, you have committed the following destructive acts:

  1. You or your guests have ripped the carpeting off of the floor;
  2. You or your guests have ripped the circuit breaker panels out of the wall;
  3. You or your guests have broken 4 windows in the dwelling;
The Landlord intends to terminate your lease in accordance with H.U.D. Rules and Regulations, and State Law.
You must make arrangements to move and return your keys to the Landlord. If you fail to do so, legal action will be instituted and the landlord shall seek to hold you liable for all Court costs and attorney’s fees incurred as permitted by law and your lease.
